Distressed Properties/Short Sales

Homeowners who are behind or at risk of falling behind on their mortgages or whose property is worth less than the amount of their mortgage may find that it is in their best economic and legal interest to sell the property. Prior to selling the property, we assist homeowners with attempting to obtain a loan modification or to refinance. If those attempts are not successful, or if the homeowner does not wish to keep the property and if the outstanding balance of the mortgage exceeds the value of the property, we negotiate with the lender to obtain its acceptance of a short sale through which the lender agrees to accept an amount less than the outstanding balance of the mortgage. If successful, we can also obtain an agreement with the bank or investor to waive the deficiency, which is the part of the loan not satisfied by the short sale.

Condominium Association Representation

We advise condominium associations, property managers, and condominium owners and their tenants with issues concerning the Condominium Property Act, condominium law in general, and issues arising out of condominium declarations, bylaws, and rules and regulations. We also represent condominium owners and associations in disputes.
